Welcome to Prextige. By accessing or using our platform, you agree to be bound by these Terms and Conditions. Please read them carefully before using any Prextige service.

Prextige is a marketplace platform that connects owners and customers, enabling peer-to-peer item rentals. The platform offers the following core services:

  • Marketplace: A digital platform where owners can list items by category, set rental prices, and define availability, and where customers can browse, book, and pay for rentals directly through prextige.com.
  • Courier Service:An optional delivery service facilitated through authorized third-party partners, available once the customer's required information has been collected — including delivery address, phone number, and ID number — and payment has been confirmed. An additional courier fee applies. All data collection is governed by Law 1581 of 2012 and Decree 1377 of 2013.

1. Acceptance of Terms

By accessing, browsing, or registering on prextige.com, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions, as well as our Privacy Policy and any other policies incorporated herein by reference. If you do not agree, you must discontinue use of the platform immediately.

2. Definitions

  • Owners: Registered users who list items they own on the platform for rental purposes. By listing an item, owners acknowledge the inherent risks of peer-to-peer rental, including possible partial or total damage, loss, or theft, and accept responsibility for the accuracy and completeness of their listings.
  • Customers:Registered users who book and rent items listed on the Prextige marketplace. Customers are directly liable to the owner for any partial or total damage, loss, or theft of the rented item occurring during the rental period, and are subject to the consequences established in the Use & Safety Policies.
  • Item or Product: Any article listed by an owner and made available for rental through the platform. The owner is solely responsible for setting the rental price, defining availability, and ensuring the item is in the condition described in the listing.
  • Rental Period: The duration of use of a rented item, as agreed upon and confirmed during the booking process.
  • Booking: A confirmed rental reservation made by a customer through the platform, which constitutes a binding agreement between the customer and the owner subject to these Terms and Conditions.
  • Security Deposit: A refundable amount collected from the customer at the time of booking, held by Prextige as a guarantee against damage, loss, or breach of the rental agreement, and released upon satisfactory return of the item.
  • Courier: An independent delivery operator — whether an individual or a company — partnered with Prextige and pre-screened through background and identity verification. Couriers are responsible for collecting and delivering items between owners and customers.

3. Scope

These Terms and Conditions govern access, registration, use, and participation on the website prextige.com, a digital platform that allows individuals and legal entities to offer and rent items to one another.

Prextige acts as an intermediary between owners and customers through prextige.com. The contractual relationships between users are understood as private rental agreements governed by the Colombian Commercial Code.

Operations on the platform carry legal validity under Law 527 of 1999 on E-Commerce, and are governed by the Consumer Protection Act (Law 1480 of 2011). Personal data is handled in compliance with Law 1581 of 2012 and its regulatory Decree 1377 of 2013.

4. Registration and Platform Use

To list items, the user must:

  • Be at least 18 years of age.
  • Provide truthful, current, and complete information.
  • List items that are in good condition and accurately described.
  • Consent to data processing under Law 1581 of 2012 and Decree 1377 of 2013.
  • Register a valid bank account to receive rental payments.

To rent items, the user must:

  • Be at least 18 years of age.
  • Provide truthful, current, and complete information.
  • Consent to data processing under Law 1581 of 2012 and Decree 1377 of 2013.
  • Have a valid payment method registered in their name, from which the rental amount, security deposit, and any applicable additional charges will be collected.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you suspect unauthorized access or a security breach, you must notify Prextige immediately at prextige.executives@gmail.com. Prextige reserves the right to refuse service, suspend, or permanently close accounts at its sole discretion, including for breach of these Terms or applicable law.

5. License and Access

Subject to your compliance with these Terms and Conditions and payment of any applicable fees, Prextige grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal, non-commercial use of the platform.

This license does not include:

  • Reselling or commercially exploiting any part of the platform or its content.
  • Collecting or using product listings, descriptions, or prices for the benefit of a third party.
  • Downloading, copying, or using account information for commercial purposes.
  • Using data mining, bots, scrapers, or similar data gathering and extraction tools.
  • Using any content generated by the platform to develop or improve machine learning models or artificial intelligence systems.
  • Framing or using framing techniques on any Prextige trademark, logo, or proprietary information without express written consent.

All rights not expressly granted to you in these Terms and Conditions are reserved by Prextige or its licensors, providers, or content suppliers. Any unauthorized use terminates the license granted herein.

6. How the Marketplace Works

Owners may list items by setting availability, rental price, and conditions. Customers may book listed items by accepting the applicable Use & Safety Policies and the owner's stated conditions. A confirmed booking constitutes a binding rental agreement between the owner and the customer.

Prextige deducts a non-refundable commission from the owner's payout on each completed booking, as detailed in Section 8 (Marketplace Fees). At the time of booking, Prextige also collects a refundable Security Deposit from the customer where required by the owner, held as a guarantee against damage, loss, or breach of the rental agreement.

At checkout, customers will be offered an optional courier service to handle item delivery and return. Owners may choose to cover the outbound delivery cost; if so, that amount is deducted from their earnings. Return delivery is the customer's responsibility, unless they hold an active PrextigeGo subscription. Free delivery offered by an owner is specific to outbound shipping only and is not available on all listings. Customers may always choose to arrange pickup and return independently, provided they comply with platform policies.

7. Returns and Cancellations

Upon expiry of the rental period, the customer must return the item to the owner in the same condition in which it was received, allowing for normal wear and tear. Returns may be arranged via the courier service (additional fee applies) or independently by the customer.

Cancellations are permitted only if the item received materially differs from its listing description or arrives in unacceptable condition, in which case a full refund will be issued. Cancellation requests must be submitted within the following windows from the time of booking confirmation:

  • Bookings with less than 24 hours' notice: within 10 minutes.
  • Bookings of 24 to 72 hours' notice: within 12 hours.
  • Bookings with more than 72 hours' notice: within 24 hours.

Risk of loss and title of rented items remains with the owner at all times. Prextige is not responsible for loss, theft, or damage caused by the customer during the rental period; however, the security deposit and dispute resolution tools are available to protect the owner's interests.

8. Marketplace Fees

8.1 Owner Commission

Prextige deducts a flat commission of 15%of the rental subtotal from the owner's payout upon each completed booking. This commission is non-refundable and is automatically deducted before funds are released to the owner. It is not visible to or charged to the customer.

8.2 Delivery and Pickup Fees

Owners may offer optional fulfillment methods — outbound delivery and/or owner-arranged pickup at the end of the rental — and set a fee for each. Owners choose whether to absorb these costs themselves or pass them on to the customer. When passed to the customer, these fees are displayed as separate line items at checkout before payment is confirmed. No delivery or pickup fee is charged by Prextige itself; all such amounts are defined and received by the owner.

8.3 Security Deposit

Owners may require a refundable security deposit per listing, which is collected from the customer at checkout alongside the rental amount. The deposit is held by Prextige and released to the customer after the rental period ends, provided the item is returned in acceptable condition. If damage or loss is confirmed, part or all of the deposit may be withheld as described in Section 10 (Sanctions and Misuse).

9. PrextigeGo Subscription

PrextigeGo is a paid monthly subscription available to customers that covers the cost of return courier service for all rentals completed during the active subscription period. It is priced at COP 30,000 and billed every 30 days from the date of subscription.

PrextigeGo subscribers benefit from doubled cancellation windows relative to the periods established in Section 7 (Returns and Cancellations).

10. Sanctions and Misuse

Prextige reserves the right to immediately suspend or permanently remove any user who lists, offers, or facilitates transactions involving prohibited items, including but not limited to firearms, bladed weapons intended for harm, contraband, or any items whose possession or commercialization is illegal under Colombian law.

Customers must treat rented items with due care. If an item is returned in a condition that does not reflect normal wear and tear, the Security Deposit may be partially or fully withheld, the customer's platform reputation score will be negatively impacted, and the account may be suspended or permanently cancelled.

Owners who misuse the platform, provide false listing information, or engage in conduct that harms customers or the platform's integrity are equally subject to reputation penalties and account suspension or cancellation.

Prextige does not tolerate discrimination on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic. Discriminatory conduct will result in immediate account suspension and may be reported to the relevant authorities. Any use of the platform for unlawful purposes will likewise be reported.

In cases where a user causes significant financial harm to items listed on the platform, Prextige may consult, store, or report information to credit bureaus in accordance with Law 1266 of 2008 (Financial Habeas Data).

11. User Content and Reviews

Users may post content on the platform including listing descriptions, photos, videos, ratings, and reviews, provided that such content is not illegal, obscene, threatening, defamatory, invasive of privacy, or infringing on any intellectual property or other rights, and does not contain viruses, spam, or any form of unsolicited communication.

Users may not use false identities, impersonate any person or entity, or otherwise misrepresent the origin of any content. Prextige does not review all content posted but reserves the right (without obligation) to remove or edit any content at any time.

By posting content or submitting material on the platform, you grant Prextige a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content worldwide in any medium. You represent and warrant that you own or control all rights to the content you post, that the content is accurate, and that its use will not violate these Terms or cause harm to any person or entity.

Reviews and ratings submitted by users must be honest and reflect genuine experiences. Prextige reserves the right to remove reviews that violate these Terms, are fraudulent, or are submitted in bad faith.

12. Intellectual Property

All content on prextige.com — including text, graphics, logos, button icons, images, audio clips, digital downloads, and software — is the property of Anuvyx S.A.S or has been legally licensed, and is protected under Colombian and international law, including Andean Decision 486 of 2000, Law 23 of 1982, and Decision 351 of 1993.

  • Reproducing, copying, modifying, distributing, publishing, or exploiting content without written authorization is strictly prohibited.
  • Trademarks, logos, and trade names of Prextige may not be used in connection with products or services other than those of Prextige, or in any manner likely to cause confusion, without prior written consent.
  • All other trademarks not owned by Prextige that appear on the platform are the property of their respective owners.

Unauthorized use may result in civil, administrative, or criminal action. Use of the site does not grant any ownership rights over its content.

If you believe your intellectual property rights have been infringed, please contact us at prextige.executives@gmail.com with a description of the alleged infringement, identification of the work, your contact information, and a statement of good faith and accuracy under penalty of perjury.

13. Indemnification

You agree to defend, indemnify, and hold harmless Prextige, Anuvyx S.A.S., and their respective affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (i) your use of the platform; (ii) your breach of these Terms and Conditions; (iii) any content you submit, post, or transmit; or (iv) your violation of any applicable law or third-party rights. This obligation survives the termination or deactivation of your account.

14. Disclaimer of Warranties and Limitation of Liability

The platform and all information, content, materials, and services made available through Prextige are provided "as is" and "as available," unless otherwise specified in writing.

Prextige makes no representations or warranties of any kind, express or implied, regarding the operation of the platform or the accuracy, completeness, or reliability of any content or listings published by users. Prextige does not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable law, Prextige disclaims all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. You expressly agree that your use of the platform is at your own risk.

Prextige shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the platform, the content of any listing, the conduct of any user, or any transaction between owners and customers — including but not limited to damage, loss, or theft of rented items. This limitation applies to the maximum extent permitted by applicable Colombian law.

Prextige is an intermediary platform and is not a party to the rental agreements concluded between owners and customers. Prextige does not own, control, inspect, or guarantee any item listed on the platform.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Colombia, including Law 1581 of 2012, Law 1480 of 2011, Law 527 of 1999, and the Commercial Code.

Any disputes will be resolved by the courts and tribunals of Bogotá, Colombia, with both parties waiving any other jurisdiction.

16. Dispute Resolution between Users

Prextige provides a Resolution Center to help owners and customers resolve monetary disputes arising from a rental — such as damage claims, deposit disputes, or cancellation disagreements.

To open a dispute, either party must contact Prextige support at prextige.executives@gmail.com within 48 hours of the end of the rental period, providing a detailed description of the issue and supporting evidence (photos, messages, etc.).

Prextige will review the submitted evidence and mediate between the parties. Its determination regarding deposit retention or release is final within the scope of the platform. Prextige facilitates this process as a neutral intermediary and does not assume direct financial liability for outcomes between users.

For disputes that cannot be resolved through the Resolution Center, both parties may pursue their rights through the applicable legal channels in accordance with Section 15.

17. Courier Service Relationship

Prextige facilitates access to a courier service operated by an authorized third-party company, which will be identified at the time of booking confirmation. Prextige is not itself a courier provider and does not assume responsibility for the courier's operations.

Prextige is not liable for delays, losses, or damages caused by the courier provider. In the event of an incident, Prextige may, at its discretion, assist the affected user in filing a claim with the courier provider, but assumes no direct financial liability for such outcomes.

By choosing to use the courier service, users acknowledge that they are engaging a separate third-party provider and agree to be bound by that provider's terms and conditions.

Use of the courier service is entirely optional. Users may arrange pickup and return of items independently, provided all platform policies are observed.

18. Platform Obligations

Prextige commits to the following obligations as platform operator:

  • Maintain a stable, secure, and functional platform for listing and renting items.
  • Review listings to ensure they meet minimum platform requirements and do not violate applicable law.
  • Provide in-platform communication tools between owners and customers.
  • Process payments, security deposits, and refunds securely and transparently.
  • Protect personal data in compliance with Law 1581 of 2012 and Decree 1377 of 2013.
  • Provide technical and operational support through official channels within the timeframes stated in Section 19.
  • Enforce compliance with these Terms and apply sanctions proportionate to the severity of the breach.
  • Facilitate mediation between users in booking disputes, acting as a neutral intermediary and without assuming direct financial liability.
  • Uphold consumer rights as established by Law 1480 of 2011.

19. Help Center and Support Channels

Prextige maintains the following official customer support channel:

The support team will respond within 3–5 business days, excluding Colombian public holidays. Requests affecting safety, active bookings, or platform integrity are prioritized.

Important: Requests submitted through unofficial channels such as social media or personal phone numbers will not be processed.

20. Delivery Times

Prextige does not control and is not responsible for courier delivery times, as the service is operated by an independent third-party provider. Customers should account for potential delivery delays when planning their rental period.

If a delay caused by the courier results in the customer being unable to use the item during the agreed rental period, Prextige will cover the return courier costs for that booking and will assist the customer in seeking resolution with the courier provider.

21. Payment and Refund Methods

All payments must be completed through the digital methods available on prextige.com, which may include credit and debit cards, and authorized cash payment networks (Baloto, Efecty via PayU). In-person card reader transactions and direct cash payments are not accepted under any circumstances.

The payment method must be valid, current, and have sufficient funds at the time of booking. If the primary payment method fails, Prextige may attempt to charge an alternative registered payment method. If payment cannot be processed, the booking will not be confirmed.

Refunds will be issued to the original payment method used, where applicable per the Returns and Cancellations section.

Owners must register a bank account to receive payments. Funds are released 10 business days after the rental period ends.

22. Tax Obligations

Users are solely responsible for determining and fulfilling their own tax obligations arising from transactions conducted on the platform, in accordance with applicable Colombian tax regulations and any other jurisdiction in which they operate.

Prextige does not provide tax advice. Where required by law or regulation, Prextige may collect, withhold, or remit applicable taxes on behalf of users and will indicate any such amounts on the corresponding invoice or booking confirmation.

Owners who generate income through the platform may be subject to income tax and other fiscal obligations under Colombian law. Prextige recommends consulting a qualified tax professional regarding individual tax obligations.

23. Right of Withdrawal

Under Article 47 of Law 1480 of 2011, the customer may exercise the right of withdrawal if:

  • The item has not been delivered or picked up.
  • No more than 5 business days have passed since the booking confirmation.
  • The cancellation complies with the Returns and Cancellations section.

If these conditions are met, the full amount paid will be refunded, minus any third-party transaction fees not within Prextige's control, provided the item has not been used or dispatched.

To exercise this right, the user must send a request to prextige.executives@gmail.com with their name, booking number, and reason.

This right does not apply if the item has already been received, the rental period has started, or if the item is personal, perishable, or would have its integrity compromised by handling — unless a verifiable defect exists.

24. Communications

By registering on prextige.com, the user expressly authorizes Anuvyx S.A.S. to send electronic communications to the email address provided during registration.

These communications may include promotions, news, updates, surveys, newsletters, receipts, and invitations. Their purpose is to keep users informed and strengthen the commercial relationship.

When you use the Prextige platform or send us electronic communications, you are communicating with us electronically. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

Users may opt out of marketing communications at any time via the "unsubscribe" link or by writing to prextige.executives@gmail.com. Transactional communications related to active bookings or account activity cannot be opted out of while an account remains active.

Personal data will be handled in accordance with Law 1581 of 2012, Decree 1377 of 2013, and other applicable regulations.

25. Off-Platform Transactions

Users are prohibited from circumventing the Prextige platform to complete transactions that were initiated or facilitated through the platform. This includes, but is not limited to, exchanging contact information with the intent to arrange rentals, payments, or returns outside of prextige.com.

Off-platform transactions deprive both parties of the protections provided by Prextige — including dispute resolution, security deposits, and platform guarantees — and may result in permanent account suspension.

Prextige bears no responsibility for any disputes, losses, or damages arising from transactions conducted outside of the official platform.

26. Pricing

Prextige may suggest rental prices based on category, condition, demand, and market averages. These recommendations are for guidance only and are not mandatory.

Owners retain full discretion to set their own rental price. Prextige does not regulate or guarantee the competitiveness or fairness of owner-set prices. By completing a booking, the customer expressly accepts the price stated in the listing at that time.

Displayed prices may not include additional costs such as rental extensions or courier fees. The total amount will be visible on the payment page before confirming the rental.

Despite our best efforts, a small number of listings may display incorrect prices. In such cases, Prextige reserves the right to contact the user before processing the booking or to cancel the order with a full refund.

27. Product Availability

Item availability is the sole responsibility of the owner, who must keep their listing current and accurate — including item condition, available dates, and pickup location.

Prextige does not guarantee the availability of any listed item. If an item becomes unavailable after a booking has been confirmed due to the owner's actions or inactions, the booking will be cancelled and a full refund will be issued to the customer.

Prextige may suspend listings whose information has not been updated or presents inconsistencies.

28. Platform Availability

Prextige endeavors to maintain continuous and reliable platform availability, but does not guarantee uninterrupted access. Service interruptions may occur due to scheduled maintenance, technical failures, or circumstances beyond Prextige's control.

Prextige will provide advance notice of planned maintenance where reasonably possible. Users acknowledge and accept that Prextige shall not be liable for any loss or damage arising from temporary unavailability of the platform.

Service will be restored as soon as possible and support will be available at prextige.executives@gmail.com. Maintenance interruptions will be announced on the homepage.

29. Platform Features

The Prextige platform provides the following features to registered users:

  • Secure intermediation: A trusted environment for managing peer-to-peer rental agreements between owners and customers.
  • Security deposit management: Prextige collects and holds security deposits on behalf of owners to provide protection against damage or loss.
  • Pricing guidance: Suggested rental prices based on category and market demand, provided for reference only. The owner sets the final price.
  • Optional courier service: Access to a third-party courier network to facilitate item pickup and delivery. An additional fee applies.
  • Customer support: Official support via email for assistance with bookings, disputes, and account inquiries.
  • Data protection: Personal data is processed securely and confidentially in compliance with Law 1581 of 2012 and applicable regulations.

Prextige reserves the right to modify, expand, or discontinue any platform feature as its business model evolves or as required by applicable law. Material changes to features will be communicated through official channels.

30. Third-Party Services and Links

Prextige integrates with or links to third-party services, including but not limited to payment processors, courier companies, and identity verification providers. If you use any of these services, you are purchasing or accessing them directly from third parties, not from Prextige.

Prextige is not responsible for examining, evaluating, or guaranteeing the offerings of any third-party business or individual. Prextige assumes no liability for the actions, products, services, or content of any third party. You should carefully review their privacy statements and other conditions of use.

The inclusion of any third-party service or link on the platform does not imply endorsement by Prextige. Use of third-party services is at your own risk.

31. Billing

Every booking made on prextige.com automatically generates an invoice to the customer covering the rental, as well as any additional charges such as the security deposit, courier fees (if applicable), and applicable taxes under Colombian tax regulations.

The invoice will include product details, duration, daily or period rate, total amount, deposit amount (refundable if no damage), and any optional service charges. Electronic billing complies with DIAN Resolution 000042 of 2020 and future updates.

Prextige may issue the invoice as a transaction facilitator. In some cases, the owner may issue the invoice directly, and this will be communicated to the user.

Invoices will be electronic, available for viewing and download in the user's profile. Physical invoices will not be issued unless required by law.

Any discrepancy must be reported to Prextige's support channel within five (5) business days of invoice issuance.

32. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

33. Modifications

Anuvyx S.A.S. reserves the right to modify, update, or replace these Terms and Conditions and any associated policies (including Use & Safety Policies, Marketplace Fees, and Privacy Policy) at any time.

For non-material changes, modifications take effect immediately upon publication on the official website. For material changes that affect user rights or obligations, Prextige will provide reasonable advance notice via email or a prominent announcement on the platform, with a minimum of 7 calendar days before the changes take effect.

Continued use of the platform after any modification takes effect constitutes full acceptance of the updated Terms. If a user does not agree with the updated Terms, they must cease using the platform and may request account cancellation prior to the effective date.
