Use & Safety Policies
These Use & Safety Policies govern the proper listing and use of items rented through the Prextige marketplace. They apply to all owners and customers and are designed to protect the integrity of rented items, ensure the safety and well-being of all users, and maintain a trustworthy platform. These policies are incorporated by reference into Prextige's Terms and Conditions and carry the same binding effect.
1. Scope
These policies apply to every item listed, booked, delivered, used, and returned through prextige.com. They cover conduct on the platform as well as the physical handling of rented items throughout the entire rental period. Acceptance of these policies is a condition of completing any booking on Prextige.
In the event of a conflict between these policies and the Terms and Conditions, the Terms and Conditions shall prevail unless these policies set a stricter standard, in which case the stricter standard applies.
2. Owner Responsibilities
Owners are solely responsible for the accuracy and safety of the items they list. By publishing a listing on Prextige, the owner warrants that the item:
- Is in the condition accurately described in the listing, including any wear, limitations, or defects.
- Is safe for use by a general adult user following the instructions provided.
- Does not require special licenses, certifications, or permits for standard use, unless this is clearly stated in the listing.
- Is legally owned or controlled by the owner and is free from any encumbrances that would prevent its rental.
- Is clean, functional, and complete with all accessories, cables, or components described at the time of handoff.
Owners must disclose any known defects, usage restrictions, or safety risks in the listing description before a booking is confirmed. Failure to do so may result in liability for damages caused to the customer, cancellation of the booking with a full refund, and disciplinary action under Section 9.
Owners must respond to customer inquiries and dispute communications within a reasonable time and cooperate fully with Prextige's Resolution Center when a claim is opened.
3. Customer Responsibilities
The customer assumes full responsibility for the rented item from the moment it is received until it is returned to the owner or courier in acceptable condition. This includes:
- Using the item only for its intended purpose and within the conditions specified in the listing.
- Preventing access to the item by unauthorized third parties, including minors, unless the item is explicitly suited for supervised use.
- Storing the item safely to prevent damage, theft, or loss during the rental period.
- Returning the item in the same condition it was received, allowing for normal wear and tear.
- Reporting any damage, malfunction, or incident to the owner through the Prextige platform immediately upon discovery.
Responsibility for the rented item rests with the customer regardless of whether the damage was caused by a third party. Prextige recommends that customers personally handle and supervise rented items at all times during the rental period.
These policies are not only intended to protect the integrity of rented items — they also aim to ensure the safety, health, and physical well-being of customers and third parties. Prextige is not responsible for any injuries, hospitalizations, or medical treatments resulting from misuse, negligent use, or use contrary to the item's instructions.
4. Prohibited Items and Listings
The following items may not be listed or rented through the Prextige platform under any circumstances:
- Weapons: Firearms, ammunition, bladed weapons intended for harm, stun devices, or any item regulated under Colombian Law 1801 of 2016 or applicable arms control legislation.
- Controlled and illegal substances: Narcotics, psychotropic substances, or any item used for the production, distribution, or consumption of illegal substances.
- Counterfeit and stolen goods: Items that infringe on intellectual property rights, are presented under a false identity, or have been obtained through unlawful means.
- Hazardous materials: Explosive devices, flammable or toxic chemicals, radioactive materials, or any item whose possession or transport is regulated or prohibited by Colombian law.
- Personal hygiene items: Undergarments, used personal hygiene products, or any item that poses an inherent health risk when shared between users.
- Items requiring professional licensing: Medical equipment, industrial machinery, or vehicles requiring a professional license, unless the listing explicitly verifies the customer's eligibility and the listing has been approved by Prextige.
- Adult content items: Sexually explicit materials, devices, or items intended for adult use only.
- Live animals.
Prextige reserves the right to remove any listing at its discretion if it determines that the item poses a risk to users, violates applicable law, or undermines the integrity of the platform. Owners who list prohibited items are subject to immediate account suspension and may be reported to the relevant authorities.
5. Guidelines by Category
In addition to the general responsibilities above, specific safety standards apply depending on the product category. These guidelines are minimum requirements; the owner's listing conditions may impose stricter standards, which customers must also respect.
- Home & Kitchen: Items must be used for domestic household purposes only. Industrial or commercial use is prohibited. Electrical components must not be submerged in water. Items must be cleaned before return. Any permanent installations must be safely reversible. Use by minors without adult supervision is not permitted.
- Technology & Electronics:Accessing, copying, or modifying the owner's data, accounts, or software is strictly prohibited and may constitute a criminal offense under Law 1273 of 2009. Unauthorized hardware or software modifications are not permitted. Items must be used in dry environments and returned with all original accessories. Attempted self-repair is prohibited.
- Tools: For use by adults with basic working knowledge of the tool type. Customers must wear appropriate personal protective equipment (PPE). Modification or alteration of tools is prohibited. Items must be cleaned and returned in proper storage condition. Power tools must not be operated near children.
- Urban Transport: Customers must wear a helmet and comply with applicable traffic regulations. Operating any transport item under the influence of alcohol or controlled substances is strictly prohibited. Carrying more passengers than the item is rated for is not permitted. Customers must verify local regulations regarding the use of electric scooters, skates, or similar items in public spaces.
- Health, Sport & Wellness: Customers must follow all usage and safety instructions provided by the owner. Sharing used personal equipment is prohibited where hygienic standards could be compromised. Customers should verify their personal health conditions before using physical equipment and are advised to consult a health professional where appropriate.
- Games, Leisure & Hobbies: Items must be used in safe and appropriate spaces. All components, pieces, and accessories must be kept together and returned intact. Subletting, lending to third parties, or modifying items is prohibited without written consent from the owner.
- Photography & Audio-Visual:Items must be handled with care and protected from impact, moisture, and extreme temperatures. Memory cards or storage containing the owner's personal data must not be accessed. Items must be returned with all original components, bags, and straps. Use in conditions not specified by the owner (e.g., underwater, industrial environments) is not permitted without prior written agreement.
6. Platform Integrity
All users are expected to interact with the Prextige platform in good faith. The following conduct is prohibited and may result in immediate account suspension:
- Fraudulent listings: Publishing listings with false descriptions, fabricated photos, or misleading availability with no intent to fulfill the rental.
- Review manipulation: Submitting fake reviews or ratings, incentivizing positive reviews, or attempting to coerce other users into modifying or retracting genuine reviews.
- Identity misrepresentation: Using false identities, impersonating another user or third party, or creating multiple accounts to circumvent sanctions or platform limits.
- Off-platform transactions: Attempting to move a rental, payment, or communication outside of prextige.com in order to avoid platform fees, protections, or oversight. This is addressed in detail in Section 25 of the Terms and Conditions.
- Harassment and discrimination: Any conduct that is hostile, threatening, or discriminatory toward other users on the basis of race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic.
- Automated access: Using bots, scrapers, or automated tools to access, collect, or interact with platform content.
Prextige does not tolerate any conduct that undermines the trust of the community. Reports of integrity violations can be submitted to prextige.executives@gmail.com with supporting evidence. Prextige investigates all credible reports and may share information with law enforcement where required.
7. Age Restrictions
All users who register and transact on Prextige must be at least 18 years of age, as established in the Terms and Conditions. Beyond general platform access, the following age-specific restrictions apply to item use:
- Power tools, motorized equipment, and items with mechanical hazards must not be operated by or near minors under any circumstances.
- Urban transport items (electric scooters, bicycles, hoverboards, etc.) may only be used by the registered customer unless the listing explicitly permits use by supervised minors.
- Technology items must not be accessed by minors without explicit owner authorization in the listing.
- Sport and wellness equipment with physical intensity or injury risk must be used by adults only, unless designed and listed specifically for supervised minor use.
The customer is fully responsible for ensuring that age restrictions are respected during the rental period. Prextige assumes no liability for incidents resulting from the use of items by individuals who do not meet the applicable age requirements.
8. Damage, Loss, and Claims
The customer is fully responsible for the condition of the rented item throughout the entire rental period. Any damage beyond normal wear and tear, loss, or theft of the item is the customer's liability.
If damage or loss occurs during the rental period:
- The customer must notify the owner immediately through the Prextige platform messaging system.
- The owner may open a formal dispute with Prextige by contacting prextige.executives@gmail.com within 48 hours of the end of the rental period, providing photos, a description of the damage, and the estimated cost of repair or replacement.
- Prextige's Resolution Center will review the submitted evidence and determine whether part or all of the security deposit should be withheld.
- The Resolution Center's determination within the platform is final. Both parties retain the right to pursue independent legal action through the courts of Bogotá, Colombia, as established in the Terms and Conditions.
In cases where the damage or loss substantially exceeds the value of the security deposit, Prextige may, at its discretion, facilitate communication between the parties but does not assume direct financial liability for the excess amount. Owners accept this limitation when listing items on the platform.
If a customer receives an item in a condition materially different from its listing description, they must report this before using the item. Use of the item after discovery of a pre-existing defect limits the customer's ability to raise a claim related to that defect.
9. Sanctions
Violations of these Use & Safety Policies may result in one or more of the following sanctions, applied at Prextige's sole discretion based on the severity, frequency, and circumstances of the breach:
- Formal warning: Issued for first-time or minor violations.
- Security deposit retention: Partial or full withholding of the deposit in cases of damage, misuse, or late return.
- Reputation impact: A negative mark on the user's platform trust score, visible to other users.
- Temporary suspension: Restriction of account access for a defined period, preventing new bookings or listings.
- Permanent account cancellation: For serious, repeated, or deliberate violations — including fraud, prohibited item listings, harassment, or actions that cause significant harm to other users.
- Legal reporting: For violations constituting criminal conduct, Prextige may report the user to the relevant Colombian authorities. In cases of significant financial harm to listed items, information may be reported to credit bureaus under Law 1266 of 2008.
Where applicable, Prextige will notify the affected user of the action taken and the reason, unless disclosure would compromise an ongoing investigation or legal process.
10. Modifications
Prextige reserves the right to update these Use & Safety Policies at any time to reflect changes in applicable law, new product categories, platform improvements, or safety learnings. Material changes will be communicated with a minimum of 7 calendar days' notice via email or a platform announcement before taking effect, consistent with Section 33 of the Terms and Conditions.
Continued use of the platform after any modification takes effect constitutes acceptance of the updated policies.
